Driving while intoxicated (or DWI) is a very serious charge. The law enforcement agencies in Houston will charge you with DWI if you are found to be having a blood alcohol concentration (BAC) of .08% or more. One can still be charged with driving under the influence of alcohol on the basis of driving symptoms, observed impairment, admissions and/or performance on the field sobriety tests. If a law enforcement officer observes enough to have a reasonable suspicion to legally justify a further detention and investigation, they will ask the driver to step out of the vehicle. Be aware, however, that the Houston DWI lawyers at Madrid, Martinez & Associates can help people charged with DWI.
